I'm sorry but it's a biscuit and not a cake.

Also, I agree with you about the Drake and Dramiel needing a nerf.

McVities argued that a distinction between cakes and biscuits is, among other things, that biscuits would normally be expected to go soft when stale, whereas cakes would normally be expected to go hard. It was demonstrated to the Tribunal that Jaffa Cakes become hard when stale. Other factors taken into account by the Chairman, Potter QC, included the name, ingredients, texture, size, packaging, marketing, presentation, appeal to children, and manufacturing process. Potter ruled that the Jaffa Cake is a cake. McVities therefore won the case and VAT is not paid on Jaffa Cakes.[6]

I'm sorry, it's legally a cake.

Eat too many and the rozzers will suspect you have the munchies and pull you over for an impromptu rectal exam or two…

…logical enough, but not one you'll be particularly likely to follow should it happen to be true. Razz

So is THAT the reason british tax collectors keep saying that the cake is a lie?

I think you will find that Her Majesty's Revenue and Customs would disagree with you.

Under UK VAT rules both cakes and biscuits are classed as essential items and zero rated - VAT is charged at 0%. However chocolate covered biscuits are considered luxury items and are charged at the full rate of VAT.

HMRC wanted to charge the full VAT as they claimed that the Jaffa Cake was a chocolate covered biscuit. A 12" jaffa cake was baked and submitted submitted along with other items of evidence and the bench agreed that the jaffa cakes are indeed cakes and NOT biscuits (chocolate or otherwise).

No, it's officially a cake.

It was decided in a court case.

If you cut a jaffa cake in half, do you get two jaffa cakes?

Also, my gf once made me a jaffa cake the size of a dinner plate, like in the pics. The orangey part was grim, but I didn't have the heart to tell her... Embarassed
