I think you will find that Her Majesty's Revenue and Customs would disagree with you. Under UK VAT rules both cakes and biscuits are classed as essential items and zero rated - VAT is charged at 0%. However chocolate covered biscuits are considered luxury items and are charged at the full rate of VAT. HMRC wanted to charge the full VAT as they claimed that the Jaffa Cake was a chocolate covered biscuit. A 12" jaffa cake was baked and submitted submitted along with other items of evidence and the bench agreed that the jaffa cakes are indeed cakes and NOT biscuits (chocolate or otherwise). |
