If the bet was ‘whoever doesn’t hold fat- today has to pay up’ then this bet is void because if you put it in football terms its like the game gets cancelled due to strong weather conditions. I.e. Server crashed for half the day

If however the bet was ‘whoever doesn’t hold fat- by xyz date (which happens to be today) then the bet should be honoured, as you said, both teams are playing on the same field.

But I am no bet expert

If one team was defending entrenched POS, and the other team was attacking entrenched PoS, there's no way in hell you can call the contest 'the same field'.

There's a reason that when massive fleets fighting over POS cause a node to crash, the people accused of intentionally blobbing to crash the node are always the defenders: attackers don't benefit from the siege being stopped.

Force majeure (French for "greater force") is a common clause in contracts which essentially frees one or both parties from liability or obligation when an extraordinary event or circumstance beyond the control of the parties, such as war, strike, riot, crime, act of God (e.g., flooding, earthquake, volcano), prevents one or both parties from fulfilling their obligations under the contract. However, Force Majeure is not intended to excuse negligence or other malfeasance of a party, as where non-performance is caused by the usual and natural consequences of external forces (e.g., predicted rain stops an outdoor event), or where the intervening circumstances are specifically contemplated.

This is honestly like saying a team loses a football game because of one bad call at the end of the game. Nevermind the other 59 minutes of play where they didn't bother to win the game, it was that last call on the final play that cost them the game.

Bet was, station would be IAC's on the 20th. Whether or not AAA destroyed our towers is beyond the point. For one, the station would in all practicality be AAA's; even if IAC we're graciously given the final blow upon seiging it, the system sov would have been AAA. IAC's own forums admit their unstellar performance in FAT and have admitted that AAA basically bailed them out to some extent (i.e. they didn't manage to keep IAC sov) with such a large fighting force.

And by the by, Last time that system hit 840 odd people, about 320 of which were bob and friends, I seem to remember BoB and pals coming out the very clear victors. So why all the sudden must AAA be the favorites yesterday? Were you planning on 1000 in local this time? Maybe 2000?

In all honesty, knowing both the pilots well enough to know that 500 mil is a drop in the bucket for either, TT should just man up and pay it. Sadly, everyone and their brother decided to come here and ***** and moan about what might have been rather than what is.

Im not even gonna talk about the bet, but this is clearly a flamebait, and a ******ed one.
IAC had to bring in friends to defend against MC, BOB, FIX, AXE, D-L and the rest? OMG ZOMG N00oBS!
And yes, i have no doubt that the coalition can field 1000 pilots now that RISE is dead, and without MC's cap fleet it looks like BOB will be in trouble.
And talking about AAA doing all the work just makes me laught, as if AXE made any diffrence in the FAT assault.

In all honesty, please stop posting **** flamebaits.

To think you really somehow managed to just spin that is amazing. Seriously, you guys are the most fanatical people in the world the way you hate BoB so much. Go outside, live life.

These forums used to be really fun. A post like this would be met by laughs and jeers from the audience. Now it's just nothing but a ***** session to deal with people's inadequacies.

I've been following this bet for a while now, and I have to throw in my 0.02 isk.

First off: The bet was accepted by both sides. This means that voiding it is out of the question. The bet entailed that if FAT was in BoB hands by today, Tyrrax would pay 500 mill to Pilk. If this was not the case, Pilk would pay Tyrrax.

Up until now: So far so good.

However, your analogy to alliance bills doesn't fly, simply because as someone else has stated "The game was still going".

All of FAT's towers were reinforced, to come out yesterday. Seeing as how the server was down the entire afternoon, the towers were saved and FAT remained in your hands.

The problem with this is that there is no way of telling how things would have went.

A better analogy would be a soccer match where IACRAA had the ball, 10 steps from the goal with no defenders in sight except the goalie. Just as the player shoots, referee whistles to halt the game because there's rain incoming.

Now, the difference is: In football this would have been cause for a major uproar. That's why given the circumstances, I'm somewhat dissapointed in Pilk for posting this in the first place, knowing full well the terms of the bet and the recent events.

I fully believe that this bet should NOT be voided. You don't agree to a bet with all of the risks involved if you are going to cancel it later, no matter what the reason.

Currently I see no other alternative but to extend the bet by a number of days agreed upon between Tyrrax and Pilk. Double or nothing could apply, again: Depending on the two opposing parties. I'd recommend around 7 days extension, more if you decide to go double or nothing.

Anyway, that's my thoughts concerning the issue.

Either a total noob or a total troll. The time when local hit 840 GBC destroyed one pos with an uber cap blob (not saying that blobbing was worse on one side or the other) that as soon as they were engaged practically everyone crashed to desktop and/or had 30 minute module lag, then if memory serves the node crashed. There was a couple of large BS engagements before hand that AAA/RA held the field in so you can't say that anybody was 'clear victors'. I for one would love to find out how that battle wouldve played out... uber cap blob and large numbers of support on GBC and vs. a LOT of bs'es (sure coalition forces prob had a fair few capitals as well) but we'll never know, just as we'll never know how FAT wouldve played out the second time round.
About the bet, its murky at best, I personally wouldn't mind paying up in those cirumstances, the date and terms were fairly clear, but then a fairly huge oppurtunity to win (or at least not lose) the bet in the 11th hour was denied one party due to unforseen events.

Bottom line, a bet it a bet.

Server stability is not promised in the EULA, and both parties are aware of this, and yet they still both agreed to the terms of the wager.

Bet stands.

All of this is kinda pointless though, as I am sure that TT would pay up anyway, as he is generally a "good guy" (yeah, I know he is a bad guy to me, but that doesn't mean I have to e-hate him).

It isn't Pilk's fault that, when they realised that the alliance were already in place to defend FAT, the coalition decided it was better to crash the server rather than being seen to fail at obtaining their objectives. Razz
(Come on, it is just as likely as the claims of BoB crashing the servers.)

It is IMO not unlikely that Pilk pretty much won that bet due to the extended downtime. It's a bit unfair and boring, but not much to do about it. Pilk could have decided to be graceful about it but did not, so just pay the man and the rest of Eve is saved from a long smacking thread filled with gloating and crap.

It's a good bet that Pilk and his pals are more in need of extra ISK anyway.

I agree entirely with this guy.

In practice the bet is won by Pilk, server downtime is a bit like an "act of god", so the bet cannot be voided on account of this. However, the honourable thing would be to extend the bet for a period of time.

If Tyrrax doesn't pay, you could say he loses some honour by not keeping his end of a gentleman's agreement. On the other hand somebody who would insist that this bet got paid, considering the circumstances is hardly a gentleman.

So........hmmm.. yeah this thread is really going places...... Laughing
