1. He shouldn't, if he has the password the system just concludes that he has permission to access the container. Even if he is flagged all it means is you could shoot him if you wanted too, but you can ignore flagging and just let the timer run out. A fleet would prevent flagging, as well as setting him to excellent personal standings.
2. A container that is deployed for self and anchored can only be unanchored by the guy who anchored it, if it is deployed for player corp then anyone in that player corp only with the right roles can unanchor it. Starting corps do not get this feature however.
Note that these containers can only be anchored in 0.7 space or lower. The containers will automatically be deleted after 30 days if they are not used as well.
