I was talking about this ToS: http://www.eveonline.com/community/fs_agreement.asp

what I see is:
1) EULAand Rules & Policies (what you can do with the game, the game client, the game data, etc...). If you are not a subscriber, it doesn't matter.
2) ToS of this website (the API, while explained in the website somehow, it's not a web content, just the documentation is a content). The webservices themselves are not a website, are not covered by that ToS. That's only for this website users. You could argue that using knowledge from this website is covered by this ToS, but not the use of the webservices.
3) the Fansite ToS or the guidelines (http://www.eveonline.com/community/fs_guidelines.asp), which is the only thing I see applicable to 3rd parties, and only for community artifacts (so no monitor apps, no fitting apps, etc...).

I was unable to find more ToS or legal documentation. If there's no anything else, the way I read it, the API is not covered specifically, which is means is covered by IP laws.

Anyway, as I said, I'm just interested in the timeline, in order to do things properly.

Don't forget the content of the static database dump. Names, Information about the Eve Universe, Systems, Regions, Ships, Items ... everything what's in the Database Dump is basically protected by CCP's IP aswell. If you make money of an application makes use of any those information/content you might have a problem aswell. Not just the API.

YES! You can create an application and charge ISK or £££ $$$ €€€ for it. It is an API what generate's XML sheet's. It's not any magical thing and there is no magical EULA or any other agreement what can prevent you doing that. You just have to use some common sense. Don't create APP soundly for EVE Online... Make it more generic... ( I'm not gonna invent the wheel for you here )

However this said. EVE Online is good game and CCP has put some serious work in to it and in my little mind I believe that if you make £$€ of it you should give some kind benefit to the CCP. Other hand Question rises what for you need the £$€? If it is for game play then just charge ISK. If it is for paying your house rent or new stockings for your GF/MOM/WIFE then... " GET AN JOB HIPPIE "

Now who can argue with that? I think we're all indebt to Gabby Johnson for stating what needed to be said. I am particulary glad that these lovely children are here today to hear that speech. Not only was it authentic frontier gibberish, it expressed the courage little seen in this day and age.
